These Terms and Conditions govern your use of the Chicory Chai (brand under ZN Brands Collective Private Limited) website at chicorychai.com (the "Site"). By accessing or using the Site, you agree to comply with these terms. Please review them periodically as they may be updated without prior notice.

Chicory Chai ("We" or "Us") reserves the right to update or modify these terms and conditions at any time without prior notice. Your continued use of the Site after any changes constitutes your agreement to the revised terms. We encourage you to review this page whenever you use the Site to stay informed of any updates.

No Liability for Damages: Chicory Chai is not responsible for any damages or viruses that may affect your devices as a result of using or browsing the Site or downloading materials from it.

Exclusion of Indirect Damages: Under no circumstances will Chicory Chai, its officers, employees, affiliates, agents, successors, or any parties involved in creating, producing, or delivering this Site, be liable for indirect, special, punitive, incidental, or consequential damages (e.g., lost profits, data, or business interruption) arising from your use of the Site, linked websites, or related content.

Local Law Compliance: These limitations may not apply in jurisdictions where such exclusions are prohibited. Please consult your local laws.

For Canadian customers: Where local consumer protection laws apply, nothing in these Terms excludes or limits liability that cannot be lawfully excluded or limited.

User Remedy: In the event of any issue with the Site or its content, your sole remedy is to stop using the Site. For issues with products or services purchased, refer to the manufacturer's or supplier's warranty, or the returns and refunds policies listed on this Site.

Accuracy of Descriptions: While we strive to ensure accurate descriptions, weights, measures, and colors are approximate and may vary based on device settings.

Product Availability: The inclusion of a product or service does not guarantee its availability.

Legal Compliance: You are responsible for ensuring compliance with local, state, and international laws when purchasing and using items from this Site.

  1. Returns and Exchanges

Returns are not permitted as these items are being shipped internationally. All sales are final. This policy applies to all international markets we serve.

If you receive a defective or damaged item, please contact us at global@chicorychai.com within 7 days of delivery with photographic evidence. We will work with you to resolve the issue through repair, replacement, or refund at our discretion.

  1. Shipping Limitations

Shipping Address: Orders are shipped to the address provided by the purchaser, subject to restrictions listed on the Site.

Risk of Loss: All purchases are made pursuant to a shipment contract. Risk of loss passes to you upon delivery to the carrier. Claims for damaged or lost shipments must be filed with the carrier.

Delivery Timeframes: 3-4 weeks for simpler, smaller designs and 4-5 weeks for larger, more complex designs. Actual delivery times may vary based on customs processing and your location.

  1. Customs, Duties, and Taxes

International orders may be subject to import duties, customs fees, and taxes imposed by your country. These charges are borne by Chicory Chai with the exception of penalties. Chicory Chai is not responsible for delays caused by customs clearance.

  1. Your Account

Responsibility: You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.

Right to Refuse Service: Chicory Chai reserves the right to refuse service, terminate accounts, remove content, or cancel orders at its discretion.

Eligibility: By placing an order, you confirm that you are at least 18 years old and that the information you provide is accurate and truthful.

  1. Currency and Payment

All prices are displayed in your local currency where available. Final charges are processed in USD and converted by your payment provider. You are responsible for any currency conversion fees charged by your bank or payment provider.

Total price including shipping and any applicable fees will be shown before purchase confirmation.

  1. Export Control

You agree not to export, re-export, or transfer products in violation of any applicable export laws or regulations, including those of India, the United States, and your country of residence.

  1. Product Warranty and Repairs

All jewelry comes with our lifetime repair promise for manufacturing defects. Free repairs are available for pieces brought in person to our New Delhi atelier. This warranty does not cover damage from normal wear, misuse, or accidents.

This warranty applies only to the original purchaser and is non-transferable.

For Japanese customers: All terms outlined in these Terms and Conditions apply, including the return policy stated in Section 5, delivery timeframes in Section 6, and pricing transparency in Section 9.

For Canadian customers: In addition to the liability provisions in Section 2, applicable provincial consumer protection legislation applies to your purchase.

  1. Disclaimer of Warranties

The Site and its content are provided "as is" without warranties of any kind, either express or implied. Chicory Chai does not guarantee uninterrupted or error-free access to the Site or that its content is free of inaccuracies or typographical errors.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of California, USA, except where:

  • Mandatory local consumer protection laws apply that cannot be excluded by agreement

  • For Canadian customers: Applicable provincial consumer protection legislation applies

  • For Japanese customers: Japanese consumer protection laws apply

Disputes will be resolved in the courts of Woodland, CA, USA.
